    Trying to predict Scientologists is sometimes nearly impossible because their behavior and thought patterns are rather--unorthodox, to put it mildly.

    I always kinda suspected ("predicted") that Marty was smart enough to use COB's greatest strength against him, in Judo style. In fact, back in December of 2012 that's the way it seemed when I posted this Nostradamus-like prediction. LOL.

    Hey, seriously, I was just guessing that was the case, but holyHell, it actually was!

    So how would you predict this whole disgraceful episode of cult Fair Gaming ends?

    I'm still chewing on how they might craft the CONFIDENTIALITY portion of the settlement so that both sides can "save face".

    But, at this point, I would estimate the case is already worth $6M - $10M for the cult to make it go away.

    I'm wondering when the cult's checks start bouncing. They spend lots of money and income has to be down. I'd love to know the real status.

    I also wonder what Marty is going for here.

    To win Mosey's case the dots have to connect DM to everything under him.
    Doing that also connects the dots between different parts of the COS/OSA/SO
    structure. That will mean all their main means of defending and hiding is totally fucked. They will be wide open. I need to be reassured of this. It looks that way to me, but they are so slippery and hard to destroy........

    So Mosey might get a large amount of money and in the process cut DM's head off.

    If the dots are all connected, the combined Mosey case, The Garcia's case
    and the Narconon cases will be like an H bomb going off at Scientology central. Let it be so.

    Believe it or not, I think Mosey will take it to the bitter end. She already took their bullshit for four years so litigation for years would be OK. She loves Marty (she stuck with him) and if they settle, you know DM will want to get even anyway and could have something done.

    I think she goes all the way and wins and probably as much as you say or more plus the Church would be done.

    I think David (I call him David) has a clear pattern of having certain enemies which he will never quit fighting.

    Wasn't Wollershiem, at one time, willing to settle for a million but David refused simply because he could not EVER allow him to get "one thin dime" and so - even without court costs - the price they ultimately had to pay him was 10 million? Simply because David could NEVER let Wollershiem win?

    It seems to me that if Wollershiem was that big of an "SP" for David, then Marty must be 100 times worse than Wollershiem ever was.

    I also think it is possible that Marty may be able to catch them violating their injunction, which might move things into criminal territory, which might bring in the dogs and the forensic accounting teams to sniff around in David's pantie drawer.

    Unlike you HH, with your track record of accurate predictions, I have no idea.

    But the feeling in my neurological system gives me certainty that Mosey will win big.

    And the amount of publicity against David will be the biggest and most damaging thing to happen to Scientology since the FBI raid and Mary Sue going to jail.

    Then that will show all the lawyers in the world where the smell of blood in the water is coming from.

    And then, it will be Total Out-Ethics and SPs Having a Field Day:

    This isn't going to be over quickly. Of course DM will use every cent & every dirty trick (legal & otherwise) to avoid taking the stand.

    I imagine a quick settlement will be offered and rejected as it will include a gag order. I just don't think Marty & Mosey are in it for a quick buck or to sell their silence. I think they want to inflict the most amount of damage they can. I'm not saying the money isn't important - it is, just that it's not their sole objective.

    I hope Ray, Mosey & Marty are in for the long haul. They will need stamina.

    And there lies the challenge--to craft a Settlement Agreement that is Solomon-like in its wisdom.

    At this point, to Miscavige, it must seem like a fight-to-the-death to close down the moat that can lead tens of thousands of future litigants into his castle. Marty and Mike's testimony is that drawbridge and if COB ends up in the "Confessor's Seat" (aka Judas Cradle) under oath in deposition and/or trial, it is going to be a spectacularly ignominious public spectacle (and extremely painful too; Ouch!)


    COB takes time out from his busy Ideal Org-Opening
    schedule to test out one of the new SuperPower
    machines, known as The Expanded "Hole" Rundown

    If that happens, I predict massive defections because I don't think parishioners are going to want to be giving touch assists to COB's afflicted area. LOL.

    So, I don't think Miscavige can conceive, at this point anyways, of any other option than a fight-to-the-death to prevent himself from being sec checked by the Wog justice system.

    But I still scratch my head thinking why if the tech was 100% workable, why must there be legal involved? Including settlement for law suits and NDA's.

    But, I know some folks would say,

    well, people aren't applying the technology of LRH and Scientoogy correctly. But, that's the point, why aren't they applying it correctly. I mean hubbard said in 1965 we have the tech. And he said scientoogy is self correcting.

    Yes, I know, DM has now discovered (invented) lost tech. ?????????

    I want to believe this (above) but for some reason, if offered enough, I think they will take the money and the gag and go and enjoy the rest of their lives in relative peace ... possibly knowing that the next person (Hello Mike) is ready, willing and able to finish the job off ... though not necessarily via the legal system.


    I wish I didn't think that but I do, and just hope I'm wrong.

    With all due respect, HH, "the settlement" and "both sides" imply Mrs. Rathbun faces only one opponent across a single settlement table - and I don't think that's true, given the number of individuals/entities named in her lawsuit, do you? :coolwink:

    What stops Mrs. Rathbun from negotiating a settlement with RTC, CSi/Co$, Miscavige, 'Private Investigator', etc. individually?

    Any negotiated settlement agreement between random Party X and Mrs. Rathbun would likely include a clause binding her to silence about the settlement amount ($$) - surely.

    But, and this is important, whatever else Party X wants Mrs. Rathbun to be silent about raises the price tag to...whatever the market will bear.

    If, for example, Party X wants Mrs. Rathbun to agree never to give an interview about, say, how it felt to be spied on for years, then Party X will have to pay for the privilege of Mrs. Rathbun's future silence about her feelings. Thus, for each type of silence Party X wants from Mrs. Rathbun, a price tag attaches. Easy-peasy...and very expensive.

    Less easy, with no visible peasy in sight however, is how Party X will fashion an enforceable clause within a settlement agreement with Mrs. Rathbun that effects silence from her husband.

    I don't think such a clause can be included within the body of a settlement agreement with Mrs. Rathbun -- but it doesn't preclude Party X from fashioning an altogether separate contract with Mr. Rathbun - his silence for financial payment. At any time prior to Mrs. Rathbun's lawsuit, of course, Party X could have offered such a contract to Mr. Rathbun - and nothing appears to preclude such an offer now or in future.

    RTC, CSI/Co$, Miscavige, etc. are each alleged to have caused harm to Mrs. Rathbun. As the discovery process continues, there's a reasonable chance additional allegations and/or additional named parties will be added. Who does it most benefit to settle right now? Who does it most benefit to wait?

    Lots of questions about settlement options/strategies to mull over in this case, but if spending upwards of $300k to have a dozen attorneys argue a piddling motion about the 'disqualification' of your opponent's attorneys is indicative of 'legal strategy tekk', then the 'settlement offer tekk' as applied to Mrs. Rathbun should be equally as fiscally irresponsible.

    I hope you're wrong too. The thing that keeps me believing that it won't happen is Marty. Look at him. That guy doesn't bend over. The only thing that might get him to do it is the toll it's taking on Mosey.

    Exactly ... that and the unfortunate fact that he is no longer as young as he was and I can't see him happily living on Mosey's income forever.

    I dont think he'd bend over for a mere 'pittance' though.
